Getting Married

Getting married in Ontario, Canada, involves various legal aspects that you should be aware of. Here are some key legal points to consider:

Marriage License: You and your partner must obtain a marriage license before getting married in Ontario. You can apply for a marriage license at any municipal office in the province. Both individuals must appear in person and provide identification, such as a passport or birth certificate.

Age Requirements: In Ontario, you must be at least 16 years old to get married. If you are under 18, you will need written consent from both parents or legal guardians. There are additional requirements if you are under 16.

Waiting Period: Once you receive your marriage license, there is a mandatory waiting period of 1 to 3 days before you can get married. This waiting period may vary depending on the municipality.

Marriage Ceremony: You can have your marriage ceremony performed by a registered religious official or a licensed Ontario marriage officiant. Ensure that the officiant is authorized to perform marriages in the province.

Witnesses: You must have two witnesses present at your marriage ceremony. They must be at least 16 years old and understand the ceremony. They will sign the marriage license as witnesses.

Marriage Certificate: After the ceremony, the officiant and the witnesses will sign the marriage license. The officiant will then send the license to the Office of the Registrar General for registration. You can apply for a marriage certificate once the marriage is registered. This certificate is an official document proving your marriage.

Name Change: If you decide to change your last name after marriage, you can use your marriage certificate as proof to update your identification documents, such as your driver’s license, passport, and social insurance number.

Solemnization: Ensure that your marriage ceremony adheres to Ontario’s legal requirements. The officiant will guide you through the necessary steps and ensure that the ceremony meets the legal standards.

Marriage Dissolution: In the event of a divorce or previous marriage, you must provide legal proof of the dissolution or annulment before getting married in Ontario.

Fees: There are fees associated with obtaining a marriage license and a marriage certificate in Ontario. The fees may vary depending on the municipality.
